During employment, employees are entitled to the timely payment of all wages earned, including overtime wages. As a rule, failure to pay these earned wages may subject an employer to penalties and interest. What is more, an employer must pay all wages earned, including accrued vacation pay, at the time of discharging an employee or within 72 hours after an employee quits without notice.
Actually, the law does not protect all employees, however, since there are certain exemptions that apply based upon the type of work being performed and/or the type of business involved. In some instances, employers misclassify employees as "exempt" from the FLSA's coverage in order to avoid overtime pay obligations. The Law Offices of Scott Michael Mishkin can evaluate whether you are, in fact, entitled to overtime payments and assist in recovering such amounts. We also offer legal assistance to employers, involved in such legal matters.
